Father Files Federal Civil Rights Lawsuit After Daughter with Disabilities Faces Retaliatory Eviction
Cincinnati, OH (February 17, 2025) — A federal civil rights lawsuit has been filed by Greg Carter, on behalf of his daughter Lauren Carter, alleging violations of the First and Fourteenth Amendments as well as the Fair Housing Act by Empowering People, Inc., doing business as Takoda Trails, and other affiliated entities.
The lawsuit stems from what Greg Carter describes as retaliation for speaking out against neglect and abuse in the care of his daughter, who has profound disabilities, including cerebral palsy and cortical blindness. The family alleges that Lauren was evicted from the state-licensed intermediate care facility Takoda Trails shortly after Greg Carter conducted a media interview highlighting systemic issues at the facility.
"Families of developmentally disabled loved ones should never have to choose between their right to speak out and their loved one's safety," said Greg Carter. "Retaliation like this sends a chilling message to anyone considering exposing abuse or neglect. This isn't just about Lauren—it’s about ensuring that no family faces what we have endured."
The eviction notice was allegedly issued within hours of the interview, citing vague claims that "the actions of the guardian" imposed an "undue hardship" on the facility. The Carters claim the actions referenced were Greg Carter’s lawful exercise of free speech and his installation of a camera in Lauren’s room under Ohio’s “Esther’s Law,” which allows families to monitor the care of their loved ones.
The complaint outlines a history of documented neglect and abuse during Lauren’s 20 years at Takoda Trails, including incidents of serious injury, lack of proper medical care, and other violations. The lawsuit also details the family’s ongoing challenges in securing alternative care for Lauren after her eviction, further illustrating systemic issues in the care of individuals with disabilities.
“This case highlights the urgent need for accountability and transparency in facilities that receive public funding to care for society’s most vulnerable,” Carter added.
The lawsuit seeks damages and injunctive relief to address the alleged retaliation, ensure due process rights for families, and challenge systemic practices that enable neglect and retaliation in state-sponsored facilities.
